    Chapter 7 Bankruptcy

    Chapter 7 bankruptcy is the ‘straight bankruptcy’ or ‘liquidation bankruptcy.’ Which is what every website says but tells you nothing.

    A Chapter 7 is simply where you say (through papers) that you can’t afford your debts. Therefore, you don’t pay them back. However, if you have stuff (fancy word: “assets”), they can take that sometimes and give that to your debts. It’s not just obvious stuff like houses or cars, but can even be your tax refund. Only a bankruptcy attorney can give you advice about whether you can or should file Chapter 7, or are at risk of losing some stuff.

    Chapter 13 Bankruptcy

    Chapter 13 bankruptcy is like debt consolidation without the calls, problems, and law suits. You keep all your stuff, and make payments back on some (not necessarily all) your debt, freezing interest. By definition the amount is supposed to be an affordable bankruptcy payment. Many bankruptcy lawyers don’t do Chapter 13 cases, because there’s a lot of work and it’s confusing. In contrast, we do, and we’ve done hundreds of them, and have a high success rate. It’s debt consolidation, with peace and quiet, and an affordable payment and an end in sight that’s doable.

    Means Test

    Not everyone qualifies for Chapter 7 bankruptcy. You don’t get to choose. Your income chooses. It surprises people when I tell them I’m more interested in their budget than debt totals. The budget helps determine whether someone can do a Chapter 7, or just makes too much money.

    So, Congress created a form called a “Means Test.” It’s a complicated formula like a tax form. Ten bankruptcy lawyers from Pasadena and Burbank and Glendale can complete one for the same client and probably get ten different results. With two decades’ experience, we’re pretty good at knowing our way around the Means Test, and helping decide if you can do Chapter 7.
